The Service Provider / We / Us / Our: Refers to Young Whippersnapper LLC, the company providing the technical support and services.
The Client / You / Your: Refers to the individual, business, or entity that engages The Service Provider for services under these Terms.
Agent(s) / Personnel / Technician(s): Refers collectively to the agents, employees, independent contractors, or other representatives authorized by The Service Provider to perform the Services outlined in this Agreement on its behalf.
1. Scope of Services
We provide technical support, troubleshooting, and consulting services. This includes:
Remote Support: Diagnosing and repairing issues via secure remote connection software.
On-Site Support: Physical hardware installation, network setup, and troubleshooting at your location.
Consulting: Providing advice on hardware/software procurement and IT strategy.
Limitations: While We strive to resolve all issues, We cannot guarantee a solution for every specific problem, particularly those involving obsolete hardware (10+ years old) or unsupported software. We strictly prohibit the use of our services for any illegal activities, including copyright infringement.
2. Access and Permissions
Remote Access: You grant us permission to access and control your computer remotely. You may monitor the session and disconnect at any time. We use industry-standard, encrypted connection tools for remote support.
Physical Access: For on-site visits, you agree to provide a safe, hazard-free working environment.
Credentials: We may require temporary access to passwords to perform updates or installations. We treat these with strict confidentiality and recommend you set temporary passwords or change your passwords once our service is complete.
3. Data Backup and Liability
Please read carefully: Electronic repairs carry inherent risks. Hardware can malfunction, and software updates can lead to data corruption.
Client Responsibility: You agree that it is your sole responsibility to back up all data (documents, photos, licensed software, etc.) prior to our arrival or remote session.
Limitation of Liability for Data and Business Loss: By engaging our services, you acknowledge that Young Whippersnapper LLC is not responsible for any data loss or corruption, loss of revenue, loss of profits, or any business interruption or other consequential damages resulting from or related to the services provided, even if We were advised of the possibility of such damages. You request service at your own risk regarding your data.
4. Payment Terms
Rates: Services are billed at $89 per hour (one hour minimum, subsequently prorated by 15 minute increments) or, if applicable and agreed in writing prior to services performed, a predetermined flat rate for a project.
Payment Due: Payment is due immediately upon completion of the service unless a prior billing agreement is in place.
Late Fees: Invoices outstanding beyond 30 days will incur a late fee of 2% per month.
5. Service Warranty
7-Day Guarantee: If the specific issue We claimed to fix recurs within 7 business days, We will remediate the issue at no additional labor cost. If any replacement part(s) are necessary, We will provide an estimate for the necessary part(s) and that You must approve the purchase before any remediation work begins.
Exclusions: This warranty does not cover new issues, issues caused by user error (e.g., re-infecting a machine with a virus), or hardware failure unrelated to our labor.
6. Limitation of Liability
To the maximum extent permitted by law, Young Whippersnapper Tech Support shall not be liable for any indirect, incidental, or consequential damages, including loss of profits or business interruption. Our total liability is strictly limited to the amount paid by the customer for the specific service in question.
7. Privacy Policy
We respect your privacy. We will not browse your personal files unless necessary for data recovery or transfer. We do not sell, trade, or share client contact information with third parties. While We can provide advice, We do not have a vested interest in Your data or how You manage it.
8. Cancellation and Termination
Cancellations: We request at least 24 hours' notice for cancellations of on-site appointments. Missed appointments without notice may be subject to a trip charge of $89 per occurrence.
Termination: We reserve the right to refuse service or terminate a session immediately if our technicians encounter unsafe conditions or inappropriate behavior.
